09 May 2006 - Child of 4 wins claim

A child of 4 was recently involved in a case after suffering injuries in a road traffic accident. At the time of the incident the child suffered whiplash type injuries and a headache. Subsequently the child in question was unable to do any type of sports for 3 weeks after the incident and continued to suffer headaches and neck pain. It later emerged that the child was suffering from travel fears due to the remembrance of the previous accident. In all the physical and mental injuries sustained took 6 to 8 months to resolve. The child was awarded £1750. |

In a recent case involving a 15 year old girl compensation was awarded of £1350. The girl in question was travelling in a vehicle which was involved in a collision causing a side window in the car to smash. The girl sustained cuts to her eye after a fragment of glass from the window entered it. She subsequently suffered pain in her left eye and blurred vision. This continued for 2 weeks and caused considerable disruption to her schooling. Do you know someone under 18 who has been involved in an accident? In a serious case in Wales, a 51 year old gentleman was involved in a road traffic accident which caused injuries to his brain and skull fractures. After many weeks in hospital he showed symptoms of aggressive behaviour, mood swings and unusual habits such as staying up late and sleeping all day. He was awarded £1000,000 in order to cover the costs of his lifetime of care required including the possibility of epilepsy appearing at a later stage in his life. In a recent case a man of 48 was involved in a road traffic accident whilst a passenger on a bus. Injuries involved consisted of soft tissue injuries to the spine. These further spread to pain around the neck which subsequently meant he couldn’t assist in household duties and caring for his newly born child. Although he continued working this was in a non physical job and so did not affect this area of his life as much as at home. However compensation was awarded of £7000 to take into account the additional disadvantage he would have in the open workplace should he have to ever look for another job. |

In a recent case a lady of 31 gained £2000 in compensation after being involved in a road traffic accident. The lady’s right wrist was jarred in the accident resulting in constant pain for around 3 to 4 months. Working on her computer and driving were difficult, as was cutting up food. An elderly gentleman of 72 was recently awarded £2750. His stationary vehicle was hit from behind by another vehicle causing a whiplash injury to the neck, pain across the shoulders and subsequent loss of neck movement for around several weeks. The injuries involved caused daily activities such as cleaning and heavy lifting difficult. After eight months he still suffered some sleep disturbance and some stiffness in the neck. In a recent case a child of 11 was involved in a slipping accident at a supermarket. Her injuries included cuts to her right ear and a blow to her head. These injuries were painful for up to four weeks after the incident disturbing school activities and causing discomfort. The subsequent scarring was predicted to be permanent. 21 Mar 2006 - Lady injured in hospital accident wins £110,000.

A recent case was made against a hospital by a patient. The woman in question went through a procedure at her local hospital. When this was completed she asked the doctor whether she could get off the bed. He said yes but the bed had been raised in order to complete the medical procedure. The patient then fell, falling heavily and breaking the top bone in her leg. After much rehabilitation she had still not recovered fully and eventual compensation of £110,000 was awarded. A nurse was recently awarded £6300 in a case involving personal injuries in a road accident. She suffered whiplash injuries to her neck which required a 3 month course of physiotherapy. She also had to have 5 months off work and suffered panic attacks due to a travel phobia brought on by the accident. A case involving a young girl was recently settled resulting in compensation of £3250, although the girl in question already had a pre-existing illness which resulted in pain to both knees. The road traffic accident in which she was involved had resulted in both knees being bruised and anti inflammatory painkillers being required. The case was settled taking into account the illness but addressing the additional pain suffered due to the collision in question. Pre-existing injuries do not necessarily negate the chance of a claim being made although these do have to be made known at the beginning of a case. Do you find yourself in this situation? In a recent case a claim was made regarding a road traffic accident. A male aged 11 suffered bruising to the back and muscle strain in the neck. He also suffered sleep disturbance and headaches in the days after his accident. Although all injuries had got better within a year of the accident compensation was awarded of £2250.
